General terms and conditions of delivery and payment

  1. The subject of the delivery is described in each offer and order confirmation. The following conditions are decisive for each delivery to be carried out by us.
  2. Delivery time: All our information on delivery times is provided at the best of our discretion. But they are non-binding. Any claims arising from any delay are excluded. In particular, claims for damages, contractual penalties, etc.
  3. Weight, quantity and dimensions are adhered to as far as possible. Fluctuations of up to 10% are due to production and cannot be objected to.
  4. The goods are shipped at the expense of the recipient. Shipments by post and forwarding agent are insured. Damages must be reported immediately to the post office, the parcel service or the forwarding agent.
  5. The packaging will be charged as cheaply as possible and will not be taken back.
  6. Defects such as small dimensional deviations, minor scratches and small air inclusions cannot be objected to. Complaints must be reported within 8 days. For defects demonstrably caused by our fault, we shall provide free replacement in the maximum case. Any other claims are excluded.
    Any liability and compensation for materials and parts supplied by the customer is excluded.
  7. Dimensional tolerances for turned and milled plastic parts are based exclusively on DIN ISO 2768-1 medium. In exceptional cases, we work according to degree of accuracy; fine.
  8. The price base for drawing parts is based on supplied step data. In the case of missing step data, we reserve the right to charge the data creation according to expenses.
  9. Prices are ex works Oberglatt, net excluding VAT and packaging. Wage and material price increases, which occur two months after the order has been placed shall be borne by the client. The minimum net invoice is CHF 100.
  10. We assert reservation of title until the purchase price has been paid in full. We are not obliged to take back the goods. In the event of any impairment of our rights by third parties, the buyer must inform us immediately. If he violates this obligation, he shall be liable to pay us damages.
  11. Terms of payment: 30 days net. Reminder chargers and default interest will be charged.
  12. Tools and moulds, including accessories, shall always remain in our possession, even if the customer has paid a share or even the entire costs for their manufacture. In this case, however, we undertake not to manufacture any pieces for third parties from the corresponding tools without the express consent of the customer. We carefully store the tools for repeat orders for two years since the last delivery. The customer shall bear the consequential cost for further storage.
  13. Samples made on request will be charged separately.
  14. Breaches of contract entitle us to withdraw from the contract without setting a deadline.
  15. Any oral agreements, in particular those with our representative, shall not be valid.
  16. Our representatives are only entitled to receive money if they are provided with a written power of attorney stating the amount of the money received: In the event of a dispute, the burden of proof lies with the client.
  17. The place of performance and jurisdiction for all obligations arising from the legal relationship between the purchaser and the supplier is Bülach, Switzerland.

Our previous general terms and conditions of delivery are superseded by the foregoing.
